Whether it’s for an added boost for a workout or a cocktail mixer from time to time during a night out (read: Vegas nights), I don’t mind having an energy drink to provide a boost, likely from the high levels of caffeine. Notice I say “having an energy drink” rather than “enjoying” as I think I’ve never heard the phrase, “Mmmm, what a delicious energy drink!” But I digress.
But one Class Action Complaint in New York federal court challenged Red Bull on what the Complaint describes as the “pervasive pattern of fraudulent, deceptive, false and otherwise improper advertising, sales and marketing practices” of Red Bull, and specifically that Red Bull:
[P]rey[ed] upon customers by promising that, among other things, “Red Bull gives you wings” by providing a mixture of ingredients that, when ingested, significantly improve a consumer’s physiological and mental performance beyond what a simple cup of coffee or caffeine pill would do for a consumer’s physiological and mental performance.
This lawsuit was joined with another Complaint with similar claims of no “competent, creditable or reliable scientific evidence exists to support [Red Bull’s] claims about the product.”
In the Settlement Order dated September 3, 2014, the administration of the settlement claims was established for a Final Approval Hearing on May 1, 2015. See the “Red Bull Settlement” website for more information on filing a claim and when payments would be made should approval be granted.

• The settlement provides cash payments or free Red Bull products to anyone who made retail purchases of Red Bull products in the United States between January 1, 2002 and October 3, 2014.
• The Court in charge of these cases still has to decide whether to finally approve the settlement as sufficiently fair and reasonable. Payments will be made if the Court approves the settlement and after appeals, if any, are resolved.
